Anyone, including family members, who has had to flee their home country to seek safety because they face serious risks to their life and safety, and while their government cannot offer them protection, or is not able to protect their life, including in regions other than their place of residence, can try to seek protection in Canada under the Geneva Refugee Convention.

According to the Immigration Refugee Board (IRB), “you are considered a refugee within the meaning of the Convention if you have a well-founded fear of being subjected to persecution in the country of your nationality for reasons of race, religion, nationality, membership in a particular social group or political opinion.”

In addition, “you are considered a person in need of protection if you would personally be subject to a risk of torture, a risk to your life or a risk of cruel and unusual treatment or punishment if returned to the country of your nationality.”

According to the IRB, if you have witnesses to your persecution case, “your witnesses will also testify. After both you and the witnesses have testified, the member will ask you or your advisor to explain the reasons why you believe you are a refugee under the Convention or a person in need of protection.”
