Has your permit expired and you lost your status? Do you want to get it back? A visitor, worker, or student whose permit has expired may apply to have their visitor or temporary resident status reinstated within 90 days of its expiration.
According to IRCC, “temporary residents who are eligible to apply for a work or study permit in Canada [R199 or R215] may do so by restoring their temporary resident status.”
If a temporary resident has lost their status (section 47 of IRPA), or has allowed their work or study authorization to lapse, they may apply to have their visitor status reinstated, in accordance with section 182 of the Immigration and Refugee Protection Regulations (IRPR).
The applicant must:
- Apply within 90 days of losing his or her status
- Meet the initial requirements for his or her stay
- Stay in Canada until a decision is made
- Not have breached any condition automatically imposed by regulation [R183] or by an officer [R185]… Such as working without authorization!
- If the applicant is recovering a Visitor Visa, he or she must be clear that a Visitor Visa is to stay in Canada, and is not a Work Permit, nor a Study Permit.
Please note that IRCC generally authorizes visitors to stay in Canada for six (6) months. However, this is not always the case, as it may be less time.
